Welcome to "PolySync: Converge" (hereinafter referred to as "the Game"). This Agreement is a legally binding contract between you and us (i.e., the game developer, hereinafter referred to as "we," "us," or "our") regarding your use of the Game services. Please read and fully understand all terms of this Agreement before using the Game.
I. General Provisions
Acceptance of Agreement. By downloading, installing, launching, or otherwise accessing the Game, you signify that you have read, understood, and agreed to be bound by this Agreement and the Privacy Policy.
Rejection Clause. If you do not agree to any part of this Agreement, please cease using the Game immediately. If relevant platform rules or laws and regulations have special requirements, those shall prevail.
Amendments to Agreement. We may modify this Agreement from time to time due to changes in laws and regulations or adjustments in operational strategies. The revised agreement will become effective automatically upon publication. We recommend that you review this Agreement periodically to obtain the latest version.
Service Adjustments. We reserve the right to adjust, suspend, or terminate part or all of the game services at any time according to operational needs, without prior notice.
II. Usage Specifications and Conditions
Cost Responsibility. All costs incurred from your use of the Game services, including but not limited to network data fees and device energy consumption, shall be borne by you.
Age Restriction. You confirm that you are at least 13 years old when you start using this service. If you are between 13 and 18 years old, please read and agree to this Agreement in the presence of your legal guardian, and use the Game under their guidance.
Assumption of Risk. You understand and agree that you assume all risks associated with downloading, installing, and using the Game. The game service is provided on an "AS IS" basis. We shall not be liable for compatibility issues or usage failures caused by factors such as your device, operating system, or network environment.
III. Accounts and Game Data
No Account Mode. To maximize the protection of your personal information security, all functions of this Game are accessible without registering an account.
Local Data Storage. Your game progress is stored locally on your device by default. Consequently, actions such as uninstalling the Game, clearing cache, or changing devices may result in the loss of game progress. To the maximum extent permitted by applicable law, we shall not be liable for any losses arising from such circumstances.
iCloud Backup (iOS Devices). You may choose to use Apple's iCloud service to back up game data. This service is operated independently by Apple Inc., and its data management is subject to Apple's terms of service and privacy policy, which are unrelated to us.
IV. Virtual Items
Acquisition Channels. Virtual currency (such as coins, gems, etc.) and other virtual items within the Game must be obtained through official channels recognized by us. We reserve the right to delete, reclaim, or invalidate virtual items obtained through unofficial or improper means (including but not limited to exploiting system vulnerabilities, using cheats or bots) without prior notice.
Usage Restrictions. All virtual items are for use exclusively within this Game. They possess no real-world currency value, cannot be exchanged for physical goods or cash, and cannot be transferred or traded outside the Game in any form.
Policy Adjustments. We reserve the right to adjust the types, pricing, acquisition methods, and functions of virtual items after providing reasonable notice (such as publishing an announcement in the Game or on the official website).
V. User Conduct Guidelines
Legality and Compliance. All your actions and content during the use of this service must comply with national laws and regulations, respect social ethics, and must not infringe upon the legitimate rights and interests of any third party.
Prohibited Actions. You must not engage in any activity that undermines game fairness, interferes with the normal operation of the Game, or infringes upon others' rights, including but not limited to:
Using, creating, or distributing any cheats, bots, accelerators, or other unauthorized third-party software.
Intentionally exploiting system vulnerabilities, program errors, or design flaws for personal or others' gain.
Engaging in any act that interferes with, disrupts, or restricts the normal operation of the game service.
Infringing upon our intellectual property rights, trade secrets, or other legitimate rights and interests, or those of any third party.
Handling of Violations. If we have reasonable grounds to believe that you have violated the above guidelines, we have the right, based on the severity of the violation and without prior notice, to unilaterally take measures including but not limited to issuing warnings, restricting game functions, and permanently prohibiting the use of the Game services.
VI. Intellectual Property Rights
All intellectual property rights contained in this Game (including but not limited to source code, art assets, characters, music, text, interface design, and related documentation) are owned by the developer and its licensors. Without our prior written permission, no individual or entity may reproduce, distribute, modify, decompile, reverse engineer, or otherwise illegally use the Game in any form.
VII. Disclaimer and Limitation of Liability
"AS IS" Basis. To the maximum extent permitted by applicable law, the Game services are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-interference, and freedom from errors.
Exemption of Liability. We shall not be liable for any losses arising from force majeure events (such as natural disasters, wars, governmental acts), issues with third-party services (such as network interruptions, device failures), or your own improper use.
Limitation of Liability. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including but not limited to loss of profits, data loss, or business interruption) resulting from the use or inability to use this service.
VIII. Miscellaneous
Governing Law. The formation, validity, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China.
Severability. If any provision of this Agreement is held to be invalid or unenforceable by a court of competent jurisdiction or competent authority, the remaining provisions shall remain in full force and effect.
Assignment. We have the right to assign all or part of our rights and obligations under this Agreement to our affiliates or subsequent acquirers or successors without obtaining your separate consent. You may not assign any of your rights or obligations under this Agreement without our prior written consent.
